As a Wendy’s customer and supporter of the Coalition of Immokalee Workers (CIW), I am writing to inform you that I am joining the CIW and consumers of conscience in boycotting Wendy’s until the fast-food chain joins the award-winning Fair Food Program (FFP).

During this year’s Annual General Meeting, Wendy’s shareholders will be presented with a proposal requesting that the Board evaluate how worker-driven social responsibility programs, like the Fair Food Program, might secure its supply chain from modern-day slavery.

In fact, cases of modern-day slavery among farmworkers are on the rise. In one recent case, nicknamed ‘Operation Blooming Onion’ by law enforcement, the Dept. of Justice announced federal forced labor and other felony charges in an indictment that detailed kidnapping, use of weapons, sexual violence and other inhumane conditions resulting in the death of at least two workers. These charges against two dozen recruiters and employers of farmworkers resulted from an investigation by federal law enforcement agencies into abuses suffered by thousands of farmworkers, primarily in the onion industry of Georgia. This case and others raises the urgent question of whether Wendy’s onions or other produce is supplied from these problematic sources.

Unlike Wendy’s current unenforceable Supplier Code of Conduct, the Fair Food Program is proven effective in preventing these human rights risks.

For over a decade, farmworkers and consumers have urged Wendy’s to make a commitment to the Fair Food Program, a historic partnership among farmworkers, farmers, and 14 multibillion-dollar food retailers, including major fast food competitors such as McDonald’s and Burger King. The FFP guarantees protections for tens of thousands of farmworkers, including the right to shade, water, electrolytes, and rest breaks as well as zero tolerance policies for sexual assault, child labor, and modern slavery.

From vague “expectations” for ethical behavior to practically nonexistent consequences for suppliers who fail to meet those expectations, Wendy's' Supplier Code of Conduct does not compare to the measurable results of the Fair Food Program. Thus, Wendy’s agricultural supply chain is exposed to systemic human rights violations that not only harm farmworkers but also open the company and its investors up to financial, legal, regulatory, operational, and reputational risks.

I look forward to the day when Wendy’s joins farmworkers and consumers in the movement for fundamental human rights for the people who do the grueling and underpaid work of feeding American families. Until then, I will be joining the hundreds of thousands of consumers boycotting Wendy’s and you will not receive any of my business.
