Remove the Deadline on the Ratification of the Equal Rights Amendment

On January 28th, resolutions to remove the deadline on the ratification of the Equal Rights Amendment were introduced as HJ Res 25 in the House and SJ Res 4 in the Senate, by Representative Pressley and Senator Cardin, respectively.

With the ERA fulfilling all requirements to become an amendment outlined in Article V of the Constitution in 2020, including passage by 2/3 of Congress and ratification by 38 states, the 1982 deadline set by Congress is the only thing standing in the way of enshrining gender equality into our Constitution.

We have the opportunity to make a huge stride toward gender equality in our nation. We have gone far too long without a legal precedent set for gender equality, something that could easily be rectified by the ratification of the Equal Rights Amendment.

The deadline to ratify the ERA passed decades ago, in 1982, but due to the hard work of gender equality activists around the country, 2020 saw the 38th state necessary to ratify an amendment to the Constitution passes the ERA on a statewide level.

Rep. Pressley's H.J. Res 25 and Senator Cardin's S.J. Res. 4 would extend the deadline for ratification of the Equal Rights Amendment, removing one of the biggest roadblocks to true gender equality in this country. This bill would allow for the ERA to be ratified, forever enshrining equality of all genders in our Constitution.

Once enshrined in our Constitution, the Equal Rights Amendment would provide a clear judicial standard for deciding cases of gender-based discrimination, create a strong legal defense against a rollback of the significant advances in gender equality that have been achieved since the mid–20th century, and allow for an expansion of power for Congress to legislate gender equality for issues like racial injustice, economic inequity, educational inequality, gender-based violence, & Queer liberation.  Not to mention how young people of all genders will feel represented and protected by our Constitution.

As you constituent, I urge you to cosponsor, vocally support, and eventually vote for the extension of the deadline on ratification for the ERA. Gender equality is an issue that has been permeating this country for far too long. This is your chance to be on the right side of history and grant women, transgender, and non-binary people the rights they deserve.
