On Monday, May 8, 2023, Florida Governor Ron Desantis signed SB264 into law, which bans certain individuals from “countries of concern” such as Iran, Cuba, Venezuela, North Korea, and Russia from purchasing property in many locations in the state. Individuals purchasing many forms of property in Florida will now have to sign an affidavit claiming they are not “domiciled” in a “country of concern,” including Iran. FL SB264 is part of a national trend of disturbing legislation attempting to ban certain immigrant communities from owning property.
Litigation to challenge the legality and constitutionality of SB264 is under development by CALDA (Chinese American Legal Defense Alliance) and seeks to include plaintiffs from affected communities, including Iranians and Iranian-Americans. The ideal candidate would be a Florida resident who either (a) owns a property in Florida with a non-immigrant visa, or (b) a real estate agent who primarily serves Iranian clients.
