Urge Governor Stein to VETO SB153 & HB318

The North Carolina General Assembly has passed SB 153 and HB 318, two dangerous attacks on immigrant communities in our state.

Senate Bill 153 would:

  • Require the Department of Public Safety, Department of Adult Correction, State Highway Patrol, and State Bureau of Investigation to enter into a 287(g) agreement with ICE. The bill would require these departments to try and determine whether an individual they are interacting with is a U.S. citizen or has legal status. 
  • Force state agencies to take additional and unnecessary steps to verify that undocumented immigrants are not benefitting from public services beyond what is required under federal law.
  • Waive certain aspects of governmental immunity for local governments that fail to comply with the anti-sanctuary ordinances.  
  • Prohibit UNC constituent institutions from adopting any type of sanctuary policies or procedures and from preventing law enforcement officials from gathering information on the citizenship status of an individual and sharing that information with federal law enforcement agencies.  

HB318 would expand the already harmful requirements of HB10 (the bill past last session that requires NC Sheriffs to cooperate with ICE) by: 

  • Expanding the list of charged offenses that trigger citizenship verification to encompass all felony charges, including nonviolent crimes. 
  • Changing the start time for the required 48-hour ICE detainer hold. Under HB318, the 48-hour clock would begin at the time the individual would otherwise be released from the facility instead of starting as soon as the ICE detainer or administrative warrant was received.  
  • Requiring that the jail administrator notify ICE within 2 hours of the planned release time for someone who was held on a detainer. 

These bills are not about making our communities safer - they're about furthering an anti-immigrant agenda, no matter the costs.
