It is estimated that 81% of convicted crack offenders were Black in 2019 despite research indicating that black and white people use crack and powdered cocaine at similar rates. In Fiscal Year 2020, 76.8% of people sentenced for crack cocaine offenses were Black. It is clear that the crack cocaine sentencing disparity is rooted in racism and bias, rather than evidence, and has largely contributed to mass incarceration particularly in communities of color.
