Dear Town Park Board Members,
As concerned residents, we ask the Board to immediately take action to remedy the concerns of the Town Park residents. For years now, we have seen the Board, either through negligence or malfeasance, allow our community to fall into disrepair and have seen Board Members not only fail to comply with the bylaws of the association but actively harass and exploit the residents of Town Park for their personal gain.
Despite the Board raising fees, we have seen no improvements to the condominium but rather an extreme deterioration of our community. Many residents have expressed concerns that the Board is misappropriating our money for purposes outside of improving or maintaining the condominium, particularly in light of the Board's non-transparency regarding spending and budget. Not only are we upset with the dismal condition that our community finds itself in, but we are deeply disturbed by the Board's abuse of power and their treatment of residents, especially vulnerable residents. Consequently, we feel that the Board is neglecting its fiduciary duties and have compiled the following list of our concerns:
The Board fails to complete any repairs that residents request; for example, residents have roof leaks which have not been fixed.
The Board declines to provide ample parking for residents, including handicapped parking, and despite this, the Board has had our cars towed and left us with the bill.
The Board refuses to implement a permit system for resident parking.
The Board ignores the mold and mildew present in common areas and units.
The Board places residents and their units at risk by refusing to hire a termite treatment company.
The Board does not maintain the common elements of the condominium, including but not limited to the gates and the parking lot.
The Board was cited with an egregiously hefty $9000 fine for violating tree ordinances.
The Board's refusal to implement security features and hire security personnel has left residents feeling unsafe in their homes. One resident suffered a gunshot injury in April 2022 while standing in front of the development.
The Board continually threatens residents with eviction when there is no cause for such action.
The Board has implemented dubious tactics in previous elections. In 2021 the Board postponed the election twice due to an undisclosed “error', created a ballot that was intentionally unclear for residents, and misled residents about when they could cast their vote.
The Board fails to hold monthly meetings with residents as required by the bylaws.
The Board has not provided residents with timely budget information in over ten years. This year the Board provided the budget for the condominium; however, they delivered it halfway through the fiscal year.
During the pandemic, the Board showed preferential treatment towards certain residents by allowing only a select few to enroll in payment plans.
Many residents have also shared concerns regarding Board President Renarda Cunningham's abusive and uncooperative behavior. The list of concerns is as follows:
Residents have experienced or witnessed several troubling actions committed by Ms. Cunnigham, including but not limited to standing outside the units of residents for prolonged periods of time, aggressively confronting residents, including elderly residents, outside their homes, selectively enforcing the covenants to harass residents she has personal issues with, and entering units without permission.
Residents are aware that Ms. Cunningham locks out other board members of the decision-making process if they disagree with her.
Residents assert that Ms. Cunningham has abused judicial and police resources. Residents allege that Ms. Cunningham has repeatedly called the police against residents and has filed restraining orders against several residents, all without cause.
Residents believe Ms. Cunningham has attempted to remove residents from their homes and acquire their units on multiple occasions. Most recently, Ms. Cunnigham sued residents in March 2022. Ms. Cunningham has also tried to enact a mechanism in the bylaws concerning whether a resident was conducting criminal activity on the premises to remove the residents.
The residents of Town Park are no longer willing to take this abuse and neglect from the Board. We request that the Board take action to remedy its deficiencies or that all Board members resign from their positions and allow us to hold free and fair elections. We expect a response and action from the Board soon and will take other measures if we are ignored.
