Sankofa CDC 2025 Hold Harmless Waiver and Photo Release Form

This form must be signed to participate in Sankofa CDC activities.  

Hold Harmless Waiver

By signing this form, I represent that I and my child/children, who are 18 years and under, are in good health and are both medically able and meet the minimum age required by Sankofa CDC for participation in all applicable programming. I understand that strenuous physical exertion may be required with the activities, and I (and my child/children) have no known physical disabilities or health problems that will present any risk by participating in this program's activities.

I agree to participate, or allow my child/children to participate, in the following activities with Sankofa CDC, including, but not limited to, nature walks, fishing, survival skills, canoeing, horseback riding, teambuilding, volunteerism, general recreation and the transportation to various locations where these activities may take place for the calendar year of 2025. I, on behalf of myself and my child/children, assume the risks associated with the participation in the stated activities, including the risk of exposure to COVID-19. 

In consideration for the ability to participate in these activities I, for myself, my child/children, and anyone entitled to act on my behalf or my child/children's behalf, waive and release Sankofa CDC, its partners and all of its employees, agents, representatives, and successors from all claims and liabilities of any kind arising out of me or my child/children's participation in these activities.

Photo Waiver

I grant Sankofa CDC the irrevocable and unrestricted right to indefinitely use and publish photographs of me (and my child/children) for marketing purposes, including, but not limited to, program guides, social media, brochures, fliers and website usage, and any other purpose and in any medium or manner, which includes alteration without restriction. I hereby release Sankofa CDC from all claims and liabilities relating to said photographs.

Horseback Riding

I acknowledge the risk of accident and injuries to person and property in all horse related activities. Therefore, in consideration of the services of Sankofa CDC and the employees of Sankofa CDC, I agree to assume the risks of all accidents, loss or damage to any equipment, or personal property, injury, or illness, to myself, to any horse(s), and to any family member or other person accompanying me on the premises of the Sankofa Wetland Park and Nature Trail. I further agree to hold harmless and indemnify Sankofa CDC and its employees from any and all claims made by any person or entity which are in any way connected with or incidental to services rendered to me or any family member by Sankofa CDC. In my absence, I authorize Sankofa CDC, its employees and any person affiliated with Sankofa CDC to arrange any emergency care they deem necessary for members of my family. This agreement shall be valid and binding at any location at which Sankofa CDC is operating.

UNDER LOUISIANA LAW, AN EQUINE ACTIVITY SPONSOR OR EQUINE PROFESSIONAL IS NOT LIABLE FOR AN INJURY OR DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITIES, PURSUANT TO LA. R.S. 9:2795.3. THIS AGREEMENT SHALL BE GOVERNED BY THE LAWS OF THE STATE OF LOUISIANA.

Canoeing

In consideration to the use of facilities, premises, and equipment of Sankofa CDC, I/we consent and understand the following:

(a) that there are potential risks, dangers, and hazards, and such risks, dangers, and hazards occur in traveling by water, including riding canoes, kayaks, and the use of paddlesport equipment;

(b) that the participation to such activities may result in bodily injury, disease, serious disability, strains, or even death; and

(c) that the risks and dangers may result in accidents caused by force majeure, or by negligence.

By signing this form and participating in these activities and/or using the related equipment of Sankofa CDC, I/we acknowledge and waive any claims against Sankofa CDC and/or its owners, affiliates, directors, partners, employees, representatives, or agents and assume the risks and dangers that are inherent in such activities and shall take responsibility for any damage, damages, losses, that may result from such activities, including but limited to injury or death.  

To participate in these activities, I/we understand that I/we must be free from any influence of alcohol or drugs, and I/we am/are in good health. I/we am/are capable of participating in physical sports and free from any condition that would prohibit participation in such activities in any way.

I/we hereby release, discharge, hold harmless, indemnify, and defend Sankofa CDC, its owners, affiliates, employees, directors, partners, representatives, or agents from any and all claims, losses, injuries, damages, and/or causes of action of any kind resulting from any incident or accident arising from my/our participation in the activities and use of equipment of Sankofa CDC.
