Dear President Biden:
We, the undersigned, support the right to live free from discrimination and we support equal access to the workforce, education, and the full range of reproductive and sexual healthcare in the United States.
Therefore, we respectfully ask that you direct the Archivist of the United States to formally certify and publish the Equal Rights Amendment (ERA) in the Constitution.
We, the undersigned, will be directly impacted or serve those who will be directly impacted by the ERA. The ERA will outlaw discrimination on the basis of sex and gender and provide strong constitutional protection from entrenched, current and potential barriers that women and people of marginalized genders face. The ERA would end gender-based pay gaps, improve workplace protections, and ensure that gender biases no longer affect hiring, promotions, or job security.
The ERA would protect against discriminatory laws including abortion bans, restrictions and bans on gender-affirming care, intrusive clinical and other requirements for providing sexual and reproductive care, and more. With the ERA enshrined in the Constitution, people who experience sex-based discrimination would have a clearer legal path to challenge discriminatory laws or policies.
We are particularly concerned for the most marginalized among us: women with limited income and resources, girls and young women, rural populations, women of color, LGBTQ, trans, and other marginalized communities, and individuals in abusive relationships.
The ERA provides: “Equality of rights under the law shall not be denied or abridged by the United States or any State on account of sex.” Having those few, simple words added to the Constitution will enshrine protections too long denied and move our country closer to the promise of equal rights for all.
We recognize and appreciate your administration's many ongoing efforts to support equality and reproductive rights. We echo the messages you have received from 46 US Senators and 122 Members of the House of Representatives, including the entire New Hampshire delegation and we join the many nonprofit organizations, led by the League of Women Voters, who urge similar action. The weight of legal authority supports your power to direct the Archivist to perform her ministerial duties with respect to the fully ratified ERA, and we ask that you seize this historic opportunity.
