Waiver of Liability for Event Participants

This waiver of liability is made by the undersigned (hereinafter referred to as the “Participant”), in favor and for the benefit of the Oyster Recovery Partnership (ORP). ORP is a non-profit organization created for the purpose of, among other things, to handle logistical elements of Maryland's oyster recovery activities. ORP regularly hosts public outreach events and the Participant has acknowledged that there are certain risks of injury to persons and damage to property associated with any physical endeavor, and is signing this waiver in order to waive any claims of liability against the Organization and to hold the Organization harmless from and against any such injury or damage, including, without limitation, claims for such injury. In consideration of the promises and the mutual covenants contained herein, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the participant does hereby understand and accept the following:

1. The Participant does hereby acknowledge that as an event participant of the Oyster Recovery Partnership, there is risk of personal injury. The Participant does hereby expressly assume the risk of personal injury. The Participant does hereby acknowledge that the Organization has made no representations or warranties regarding the safety of the event.

2. The Participant does, for himself or herself, and on behalf of his or her personal representatives, heirs and assign, waive, relinquish, discharge and forever release any and all claims, actions, and causes of action against OR (including its directors, officers, employees and agents), and their successors and assigns to the fullest extent permitted by law, which in any manner may arise form any loss, damage, or injury, direct or indirect, which the Participant may experience or be subject to as a result of his or her participation in the event. The Participant further acknowledges that participation in the event is not part of his or her employment duties or responsibilities with or for the ORP.
