I am writing to urge you to fully restore the original definitions of “waters of the United States” as Congress intended under the Clean Water Act. Specifically, EPA and the Corps should fully restore the 1970s definition that is currently in place without modifications that limit protections for rivers, streams, wetlands, lakes, and other waters.

The federal Clean Water Act is essential to protecting rivers, streams, lakes, wetlands, and coastal waters, and to protect the people and communities that depend on clean water for their survival. A clear, broad regulatory definition of “waters of the United States” is critical for protecting the drinking water for millions of Americans, reducing the public’s exposure to toxic metals and pollution, and preventing the contamination of thousands of miles of waterways across the country. Waterways do not exist in isolation. To restore and protect water quality in our nation’s waters we must control the discharge of pollution at its source—wherever that source may be located.

Many waters across the country are severely polluted and cannot be restored and protected unless they are included within the definition of “waters of the United States.” The definition adopted in the 1970s is protective of the nation’s waters and complies with the Clean Water Act. That definition should not be modified as proposed in the rulemaking because those new limits will leave important waters unprotected.

I encourage you to fulfill the original intention of the Clean Water Act by protecting all of the nation’s waters from pollution and destruction.
